Terms of Sale

1. Preamble

These Terms of Sale (hereinafter "ToS") govern the sale of subscriptions and credit packs on the Photo to Listing website. They supplement the Terms of Service.

By making a purchase, you acknowledge having read these ToS and accept them without reservation.

Prices are in USD. TCTB reserves the right to modify prices at any time. Price changes do not apply to current subscriptions.

4. Order

4.1 Order Process

1. Create an account or sign in
2. Select your desired plan
3. Review order summary
4. Complete secure payment via Stripe
5. Receive confirmation by email

4.2 Confirmation

Upon receipt of payment, you will receive a confirmation email with your order details. Your subscription or credits will be activated immediately.

5. Payment

5.1 Payment Methods

Payments are processed by our partner Stripe. Accepted methods:

• SEPA Direct Debit (where available)

5.2 Security

Your payment details are never stored on our servers. Stripe is PCI-DSS Level 1 certified, the highest level of payment security certification.

5.3 Invoicing

Invoices are accessible from your account via the Stripe portal. A billing email is sent for each transaction.

6. Subscriptions

6.1 Duration and Renewal

• Pro Monthly: One-month duration, automatically renewed each month
• Pro Annual: One-year duration, automatically renewed each year

6.2 Cancellation

You can cancel your subscription at any time from your Stripe billing portal, accessible via your account settings.

Cancellation takes effect at the end of the current subscription period. You retain access to Pro features until that date.

6.3 Subscription Modification

You can switch from monthly to annual subscription (and vice versa) at any time. The change takes effect at the next billing cycle.

7. Right of Withdrawal

7.1 Principle

You have 14 days from subscription to exercise your right of withdrawal without having to justify reasons.

7.2 Exception for Digital Services

The right of withdrawal cannot be exercised if you have started using the service (generating listings) after expressly consenting to immediate contract execution and waiving your right of withdrawal.

7.3 Exercising Right of Withdrawal

If you have not yet used the service, you can exercise your right of withdrawal by contacting us at contact@phototolisting.fr.

8. Refunds

8.1 Refund Conditions

Refunds are possible in the following cases:

• Exercise of right of withdrawal (if eligible, see section 7)
• Verified duplicate billing
• Extended service unavailability attributable to TCTB

8.2 Credit Packs

Credit packs are non-refundable once the first credit is used. Unused credits cannot be converted to cash.

8.3 Procedure

For any refund request, contact us at contact@phototolisting.fr with your order number. Refunds are processed within 14 days via the original payment method.

9. Service Availability

We strive to ensure maximum service availability. However, interruptions may occur for maintenance or force majeure.

In case of extended unavailability (more than 72 consecutive hours), you may request an equivalent extension of your subscription or pro-rata refund.

10. Liability

TCTB's liability is limited in accordance with the Terms of Service.

In no event shall our liability exceed the total amount paid by the customer during the last 12 months.

11. Data Protection

Personal data collected during your purchases is processed in accordance with our Privacy Policy.

13. Dispute Resolution

In case of unresolved dispute, you may use consumer mediation services free of charge.
